Most debates about lawyers professional responsibilities ultimately devolve into discussions of the “role” of lawyers-including the functions lawyers serve in the legal system, how lawyers should achieve those functions, and how lawyers should reconcile conflicts between competing interests that are potentially affected by their conduct. The notion of a lawyers role can be helpful for identifying principles of behavior. Thus, for example, whether attorney-client confidentiality is appropriate and whether exceptions should be acknowledged depends on the conception of lawyers from which one starts. If lawyers are to be clients sole and fully-allied champions, then strict confidentiality rules make sense. If lawyers are to be objective intermediaries between clients and society and have independent obligations to the law, exceptions seem more acceptable. The task of code drafters is facilitated when they can proceed from the assumption that a single paradigm governs the lawyers role-either a paradigm encapsulating a theory of behavior (how lawyers ordinarily act) or a paradigm encapsulating a normative ideal (how lawyers should act). When code drafters rely upon multiple paradigms (for example, lawyers should act as clients alter egos and as officers of the court), inconsistent regulatory mandates can result, and lawyers may become confused about their functions. The ABAs 1908 Canons of Ethics, which prevailed in most American jurisdictions throughout the early twentieth century, suffered from an emphasis on inconsistent ideals.1 The bar was in a state of disagreement about lawyers roles and lawyers had no point of reference for determining how to act.2 Therefore, when the ABA adopted the first concrete professional code in 1969,3 it became important for the drafters to identify an over-arching theory. By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted. Part I of this Article identifies some of the different images of lawyers that exist6 and the ramifications of emphasizing each image in the professional codes. Initially at least, this Article takes no position on the accuracy of the images in describing lawyer behavior-for example, whether lawyers act in a selfinterested manner or whether lawyers feel bound by unenforceable professional norms. As a practical matter, each of the images has solid footing in some respects. That is to say, each is based on a valid characterization of how lawyers act in some situations. Part I will suggest, however, that relying upon multiple paradigms inevitably fosters schizophrenia on the part of the code drafters.

inaugural Diet Year in Review. To start, the review examined the most
popular diets for 2007 which this year were, in order, the South Beach
Diet, Weight Watchers, Atkins and the Fat Smash Diet. In terms of weight
loss results for these popular diets, the Fat Smash Diet actually led the
pack with people losing on average 1.02 lbs a week, compared to 0.73 lbs
for the South Beach Diet, 0.65 lbs for Weight Watchers and 0.63 lbs for
Atkins.

some of the dieting powerhouses like the South Beach Diet and Weight
Watchers continue to be popular, there is a trend emerging in favor of
weight loss programs endorsed by celebrities or those popularized on
reality TV shows such as the Fat Smash Diet, which featured on VH1s
Celebrity Fit Club.”

Looking at weight loss performance across all popular diets, the Fat Smash
Diet was the leader, followed by (on an average weekly basis) the Sonoma
Diet (0.94 lbs), Abs Diet (0.92 lbs) and the GI Diet (0.79 lbs). Though
the average weight loss for people following a popular diet was 0.72 lbs a
week, those following their own personal diet program achieved an average
weight loss of 0.89 lbs. “The out-performance by people doing their own
diet is surprising and highlights that determination and support play a big
part in getting results,” said Moses.

Another interesting review finding was the magnitude of the benefit from
complying with your diet closely compared to just following it reasonably.
Those who reported that they were sticking to their diet to the letter
achieved a rate of weight loss 1.5 times those who just followed it
reasonably. The perfect dieters lost an average of 1.87 lbs a week versus
the OK dieters who lost 1.25 lbs, highlighting the enormous advantage of
being disciplined in your diet approach and management.

When considering the weight loss battle of the sexes, it was the men who
shone through. Male dieters lost on average 1.03 lbs a week, versus women
who lost 0.78 lbs. In terms of diet performance by age group, there was
some support for the commonly held view that metabolism slows with age.
Women aged under 29 lost 0.83 lbs a week and the rate of weight loss
declined progressively in each subsequent 10 year age range, although the
drop off in the rate was not as drastic as one might have expected, with
women aged over 60 still losing 0.73 lbs a week. For men on the other
hand, there was only modest correlation between age and the rate of weight
loss.

By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted. Part I of this Article identifies some of the different images of lawyers that exist6 and the ramifications of emphasizing each image in the professional codes. Initially at least, this Article takes no position on the accuracy of the images in describing lawyer behavior-for example, whether lawyers act in a selfinterested manner or whether lawyers feel bound by unenforceable professional norms. As a practical matter, each of the images has solid footing in some respects. That is to say, each is based on a valid characterization of how lawyers act in some situations. Part I will suggest, however, that relying upon multiple paradigms inevitably fosters schizophrenia on the part of the code drafters.

German car maker Volkswagen said Thursday it will begin distributing its New Beetle Cabrio next week. The convertible, an adaptation of the New Beetle that Volkswagen launched five years ago, will head to the U.S. market next month, company officials said. Volkswagen expects to manufacture 60,000 Beetle Cabrios this year. The New Beetle, its convertible cousin, the original “bug” and the Bora/Jetta models are manufactured at Volkswagens Puebla plant in central Mexico. With the launch of the Beetle Cabrio, production at the Puebla plant is expected to rise to 350,000 units this year from 332,000 in 2002. INTRODUCTION AND SUMMARY In order to take advantage of credit portfolio management opportunities, however, management must first answer several technical questions: What is the risk of a given portfolio? How do different macroeconomic scenarios, at both the regional and the industry sector level, affect the portfolios risk profile? What is the effect of changing the portfolio mix? How might risk-based pricing at the individual contract and the portfolio level be influenced by the level of expected losses and credit risk capital? This paper describes a new and intuitive method for answering these technical questions by tabulating the exact loss distribution arising from correlated credit events for any arbitrary portfolio of counterparty exposures, down to the individual contract level, with the losses measured on a marked-to-market basis that explicitly recognises the potential impact of defaults and credit migrations.1 The importance of tabulating the exact loss distribution is highlighted by the fact that counterparty defaults and rating migrations cannot be predicted with perfect foresight and are not perfectly correlated, implying that management faces a distribution of potential losses rather than a single potential loss. In order to define credit risk more precisely in the context of loss distributions, the financial industry is converging on risk measures that summarise management-relevant aspects of the entire loss distribution. Two distributional statistics are becoming increasingly relevant for measuring credit risk: expected losses and a critical value of the loss distribution, often defined as the portfolios credit risk capital (CRC). Each of these serves a distinct and useful role in supporting management decision making and control (Exhibit 1). Expected losses, illustrated as the mean of the distribution, often serve as the basis for managements reserve policies: the higher the expected losses, the higher the reserves required. As such, expected losses are also an important component in determining whether the pricing of the credit-risky position is adequate: normally, each transaction should be priced with sufficient margin to cover its contribution to the portfolios expected credit losses, as well as other operating expenses. Credit risk capital, defined as the maximum loss within a known confidence interval (for example, 99 percent) over an orderly liquidation period, is often interpreted as the additional economic capital that must be held against a given portfolio, above and beyond the level of credit reserves, in order to cover its unexpected credit losses. Since it would be uneconomic to hold capital against all potential losses (this would imply that equity is held against 100 percent of all credit exposures), some level of capital must be chosen to support the portfolio of transactions in most, but not all, cases. As with expected losses, CRC also plays an important role in determining whether the credit risk of a particular transaction is appropriately priced: typically, each transaction should be priced with sufficient margin to cover not only its expected losses, but also the cost of its marginal risk capital contribution. In order to tabulate these loss distributions, most industry professionals split the challenge of credit risk measurement into two questions: First, what is the joint probability of a credit event occurring? And second, what would be the loss should such an event occur?

The ability of the printing industry to sustain the modest recovery begun last spring was brought into doubt by a continuing decline in key printing business indicators, according to the July Printing Business Conditions Special Update, issued by the National Association for Printing Leadership (NAPL), the trade association for the commercial printing industry, based in Paramus, NJ. Despite the decline, NAPL expects the recovery to continue and activity to accelerate this fall, although the anticipated recovery will be too little and too late. Total print sales are expected to decline in 2002, marking the industrys second consecutive year of declining sales in nearly three decades. The NAPL Printing Business Index (PBI), the associations comprehensive measure of printing industry activity, fell to 45.1 in July, down from 45.6 in June. The PBI has now been under the 50.0 mark for three consecutive months and has fallen 15.9 percent since attaining a 19-month high of 53.6 in April of this year. A PBI reading above 50.0 signifies that more printers report business is picking up than report business is slowing down. Conversely, an index reading below 50.0 indicates the opposite condition. According to Andrew Paparozzi, NAPL vice president and chief economist, “Originally we expected print sales to grow 2.2 to 3.4 percent in 2002. But thats not going to happen. Recovery has been even more muted and erratic than we expected. Print sales were very weak through midyear, and the second half isnt exactly off to a flying start. Sales will benefit from more favorable year-to-year comparisons as we move into the third and fourth quarters. However that will not rescue the industry from a second consecutive year of declining sales for the first time in nearly three decades.
